1. General Use of Website

1.1  www.smartsibotest.com is a website operated by Smart Nutrition Ltd (Company No. 04575835). By using this website, or ordering via telephone or email, you are deemed to have read and agreed to be bound by these Terms and Conditions just as if you had signed this agreement.

1.2  We reserve the right, at our discretion, to change, modify, add or remove portions of these Terms and Conditions at any time without prior notice. All changes become immediately applicable to all users of this website. You should check these Terms and Conditions periodically for changes. By using this website after any changes are posted, you agree to accept and be bound by those changes. If you do not agree, please do not use our website and, if applicable, notify us to terminate your registration.

2. General Content

2.1  Images and other product information on this site are for illustration only and may not accurately represent product contents or most recent packaging. Prices displayed online may differ from catalogue prices and special offers may be available from time to time.

2.2  The information contained in this website has been prepared solely to provide general information about Smart Nutrition Ltd, its partners and the services they offer. No information given is an alternative to seeking professional medical advice where appropriate.

2.3  Whilst every effort has been made to ensure accuracy, information on this site does not constitute any form of advice, recommendation, representation, endorsement or arrangement by Smart Nutrition Ltd.

2.7  Manufacturer’s recommended cautions and contraindications are listed where possible, but we accept no responsibility for failure to mention possible interactions between any product sold by us and other medications or supplements. If no contraindication is highlighted, it cannot be assumed that it is safe to combine medications and any test substrate. You should seek professional advice before combining.

2.8  You expressly understand and agree that Smart Nutrition Ltd and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages arising out of: (a) use or inability to use the site; (b) use of any content or material on the site or any linked website; (c) cost of procurement of substitute goods or services; (d) unauthorised access to or alteration of your data; (e) statements or conduct of any third party on the site; or (f) any other matter relating to smartsibotest.com. In no event shall our total liability to you exceed the amount paid by you, if any, for accessing our website.

3. Our Services

3.1  Smart SIBO Test provides SIBO (Small Intestinal Bacterial Overgrowth) breath testing services. Depending on the test purchased, the service includes:

• A home SIBO breath test kit containing all equipment and instructions required to collect breath samples
• Laboratory analysis performed by an independent, accredited third-party laboratory using certified Quintron equipment
• Written interpretation of your results by a qualified clinician or functional medicine practitioner

3.2  Two types of SIBO breath test are available: the Standard SIBO Breath Test (hydrogen and methane) and the Glucose SIBO Breath Test. The differences between these tests are explained on the product pages. Please read these carefully before ordering.

3.3  For customers based in the United Kingdom, most tests include written interpretation and commentary by a qualified clinician or GMC-registered doctor (GP), unless you choose to opt out.

3.4  For customers based outside the United Kingdom, results are reviewed by a suitably qualified nutritional therapist or functional medicine practitioner. GP review is not available to non-UK customers due to regulatory, licensing and jurisdictional considerations. This will be made clear before purchase.

3.5  Results are returned within 7 working days of the laboratory receiving your samples. We aim to return results sooner where possible.

3.6  The laboratory analysis forms an integral part of the overall service. Results are reviewed in the context of the information you provide.

3.7  The reviewing professional exercises independent clinical judgement when interpreting your results. Commentary may incorporate structured or templated elements to ensure consistency and safety, but is personalised to your individual results and the information you provide.

3.8  The Smart SIBO Test is designed to support investigation of potential Small Intestinal Bacterial Overgrowth. It does not replace ongoing care, assessment or treatment by your own GP or healthcare provider. A positive result does not constitute a clinical diagnosis and you should discuss your results with your GP or a qualified healthcare professional before making any treatment decisions.

3.9  The Smart SIBO Test does not include a treatment plan as part of the service.

3.10  This service does not provide emergency medical care. If you believe you are experiencing a medical emergency, call 999 or attend your nearest A&E immediately.

3.11  The SIBO breath test may not be suitable for all individuals. Please read the preparation and contraindication guidance carefully before ordering. If you are unsure whether the test is appropriate for you, please contact us at admin@smartnutrition.co.uk or consult your GP before placing an order.

4. Clinical Review and Test Results — Important Information

4.1  Our service includes written interpretation of your laboratory results by a qualified clinician or functional medicine practitioner. For UK customers, this review may be carried out by a GMC-registered doctor (GP). This review is provided as part of a service designed to support the assessment, monitoring, protection and maintenance of your health.

4.2  The review is based on your laboratory results and any information you provide. It does not constitute a full medical consultation, does not establish an ongoing doctor-patient relationship beyond the scope of the specific test, and should not be treated as a definitive clinical diagnosis of any condition.

4.3  The reviewing clinician or practitioner exercises independent professional judgement. Their commentary will: indicate whether your results are positive or negative for hydrogen, methane or possible hydrogen sulphide SIBO; provide written interpretation to help you understand what your results may indicate; and advise where further medical follow-up with your own GP may be appropriate.

4.4  A supporting interpretation guide will be provided with your results, which you may share with your GP or healthcare provider.

4.5  Based on your results and/or other information you have provided, we may recommend a follow-up test or further investigation, or both. You are solely responsible for acting on such guidance. Smart Nutrition Ltd accepts no liability in the event you choose not to do so.

4.6  You may opt to receive laboratory results only, without clinician commentary. By choosing this option you accept that: (a) no clinical review will be provided; (b) you will share any results outside the normal range with your GP or a qualified medical professional; and (c) Smart Nutrition Ltd shall not be liable for any consequences arising from your failure to do so.

5. Pre-Test Preparation and Sample Collection Instructions

5.1  The SIBO breath test requires specific preparation before sample collection. You must follow a low-fermentation preparation diet for 1 day before the test (or 2 days if you are constipated), and fast overnight before collecting your samples. Full preparation instructions, including meal plan ideas, are provided with your kit.

5.2  Where special preparation is required, we will provide you with clear written instructions. It is your responsibility to read and follow these instructions carefully before collecting your sample.

5.3  If you do not follow the preparation and collection instructions provided, Smart Nutrition Ltd will not be responsible for any impact on the accuracy or validity of your test results. Results compromised by failure to follow instructions are not eligible for a refund or free replacement kit.

5.4  Breath samples must be returned to the laboratory within 7 days of collection using the return postage provided. Smart Nutrition Ltd is not responsible for results that are compromised due to delays in returning samples or where samples are lost in transit.

5.5  Some test preparations, including fasting, may not be suitable for everyone. If you have a medical condition, are pregnant, are taking prescribed medication, or have any concerns about whether the preparation requirements are appropriate for you, we strongly recommend that you consult your GP or a qualified healthcare professional before proceeding. Smart Nutrition Ltd accepts no responsibility for any adverse effects arising from following test preparation instructions where an individual has an underlying health condition that makes such preparation unsuitable.

5.6  The SIBO breath test is suitable for children over 50 lbs who are able to blow into a tube. For children under 50 lbs, please contact us before ordering as the dosage of the preparation solution will need to be adjusted. Orders for children under 18 must be placed by a parent or guardian.

6. Health Questionnaire and Suitability

6.1  You must complete any required health questionnaire accurately and honestly. The questionnaire is an essential part of the service and supports the safe and clinically appropriate interpretation of your results.

6.2  Turnaround times are for the testing process and review of your results. If the health questionnaire is not returned prior to the completion of your results, this will extend the time it takes to fully review and release your result. It is your responsibility to complete the questionnaire in time.

6.3  You are responsible for checking that the test is suitable for your individual circumstances before placing your order, including any relevant symptoms, medications, medical conditions, pregnancy status or contraindications described on the product page or in the FAQs.

6.4  If you are unsure whether the test is appropriate for you, please consult your GP before ordering or contact us at admin@smartnutrition.co.uk.

6.5  We may decline to process a test or provide commentary where the questionnaire is incomplete, where clinical safety requires it, or where the reviewing clinician determines that a safe assessment cannot be made on the information available.

7. Professional Review

7.1  For UK customers, clinical review or interpretation is carried out by a GMC-registered doctor or qualified functional medicine practitioner exercising independent professional judgement.

7.2  For non-UK customers, interpretation is provided by a suitably qualified nutritional therapist or clinician, reflecting regulatory, licensing and jurisdictional requirements.

7.3  Review is based solely on your laboratory results and any information you provide. It is not a full medical consultation and does not create an ongoing doctor-patient relationship.

7.4  Where results indicate a potential concern, you may be advised to seek further evaluation from your own GP or healthcare provider.

7.5  If you opt out of professional review (where that option is available), you will receive laboratory results only and will be responsible for discussing those results with an appropriate healthcare professional.

8. Copyright and Use of Materials

8.1  The Smart SIBO Test website contains information, software, photos, video, text, graphics, music, sounds, articles and other materials (collectively, “Contents”) that are protected by copyright, trade secrets and other proprietary rights. All Content is owned by or licensed to Smart Nutrition Ltd under UK copyright laws.

8.2  You may not modify, publish, transmit, distribute, perform, transfer, sell or exploit any of the Content, in whole or in part, except that you may download one copy on any single computer for personal, non-commercial home use only, provided you do not change or delete any author attribution, trademark, legend, copyright or other proprietary notice.

9. Third Party Copyright

9.1  The products described on this website may be subject to intellectual property rights reserved by Smart Nutrition Ltd or third parties. No licence is granted in respect of those rights.

9.2  Images, pictures, videos, logos and graphics on this site are protected by copyright and may not be reproduced or appropriated in any manner without the written permission of their respective owner(s).

10. Privacy Policy and Data Protection

10.1  We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

10.2  Smart Nutrition Ltd takes the confidentiality of your personal data seriously. All information you share with us will be strictly confidential. We only share relevant information with the laboratories we send your test orders to and the clinicians who interpret your test results. We do not share your data with any other persons or bodies, except as required by law.

10.3  By purchasing a test, you consent to us sharing relevant personal and health information with: (a) the Referral Laboratory for sample analysis and reporting; and (b) the reviewing clinician for result interpretation and commentary (where included).

10.4  We may retain records of communications, results and reports for clinical governance, customer service, legal compliance and quality assurance purposes.

10.5  Incoming calls may be recorded to improve our efficiency and as a record of any telephoned orders.

10.6  You are entitled to see all information we hold about you and to request corrections. Please email admin@smartnutrition.co.uk or write to Smart Nutrition Ltd, Sedgebrook House, Radley Road, Halam, Nr Newark, Notts, NG22 8AQ.

10.7  We will not give, loan, sell or rent any of your personal details to third parties unless legally required to do so or with your clear written consent.

10.8  This privacy policy applies solely to personal data collected by Smart Nutrition Ltd and does not apply to third-party websites accessible from this site.

11. Pricing and Payment

11.1  Prices payable for goods are as set out on our website and are inclusive of any delivery charges except where specifically stated otherwise.

11.2  We must receive payment for the whole price of the goods, including any delivery charges. Payment may be made via PayPal or Stripe. Please note that Smart Nutrition Ltd will appear on your PayPal receipt.

11.3  Once payment has been received, we will confirm your order by sending an email to the address you provided, stating your Order Reference Number.

11.4  If we are unable to fulfil an order due to inability to obtain supplies, we will refund your payment by the same route it was made.

11.5  Special offers are for a limited time only. All transactions must be in sterling.

11.6  Acceptance of your order brings into existence a legally binding contract between us. Only those aged 18 and over are entitled to enter into legally binding contracts and to purchase through this site. By ordering, you confirm that you are aged 18 or older. Orders for children under 18 must be placed by a parent or guardian.

11.7  We reserve the right to correct pricing errors. If an error affects your order, we will contact you and offer the option to proceed at the correct price or receive a full refund.

11.8  It is not permitted to resell, auction or gift a test to another person or organisation.

12. Delivery

12.1  Test kits are dispatched directly to you by our Partner Laboratory. Kits will be delivered to the address provided at the time of checkout. For security purposes, both Smart Nutrition Ltd and our Partner Laboratory reserve the right to restrict delivery to the billing address only. By placing an order you agree that either Smart Nutrition Ltd or our Partner Laboratory may apply this restriction at our discretion and without prior notice.

12.2  Both Smart Nutrition Ltd and our Partner Laboratory aim to dispatch test kits within 2–3 working days of your order being confirmed. In many cases kits are dispatched within 24 hours. However, we cannot be held responsible for delays caused by third-party postal or courier services. In all cases we will endeavour to ensure delivery within 30 days of your order.

12.3  If goods are not delivered, or are damaged or defective due to circumstances beyond our control, we will offer a refund or replacement. Please note we are unable to act until the 30-day delivery period has elapsed, or unless goods are returned to us unopened and in a condition fit for resale.

12.4  Our liability for late delivery or failure to deliver is limited to the price paid for the goods, excluding postage costs.

12.5  Risk of loss or damage passes to you upon delivery. Ownership of the goods transfers to you at the point of dispatch.

12.6  If the goods delivered are not what you ordered, are damaged or defective, or the quantity is incorrect, we shall have no liability unless you notify us by email within 7 working days of delivery.

13. Postage

13.1  For UK customers, free Royal Mail 24-hour tracked return postage is included with your test kit for returning your breath samples to the laboratory.

13.2  Outbound delivery of test kits to mainland UK and Northern Ireland is charged at £5. Delivery to Highland and Island areas may incur additional postage charges.

13.3  For customers in Europe and the rest of the world, postage will be calculated at checkout. Some international destinations may incur an additional postage fee. If your country is not covered at checkout, please contact us at admin@smartnutrition.co.uk.

13.4  International customers are responsible for ensuring that their breath samples are returned to the laboratory within 7 days of collection. Samples may be posted by airmail.

13.5  The delivery of test kits and the return of test samples to the laboratory are carried out by third parties (Royal Mail or courier companies). We cannot be held responsible for any delay or loss while items are in the hands of a third party.

14. Test Time Frames

14.1  All tests must be completed within 3 months of ordering. If not completed within this period, an administration and handling fee of £50 will be charged, plus any increase in the test fee since the date of order.

14.2  Many tests have a use-by date. All tests must be completed and returned to the laboratory before the use-by date. It is your responsibility to ensure you use the test within this time frame. If not completed within this period, an administration and handling fee of £50 will be charged, plus any increase in the test fee since the date of order.

14.3  Whichever of 14.1 or 14.2 falls earliest takes precedence.

14.4  One year or more after the date of order, you are no longer able to complete the test and are not eligible for a refund.

15. Cancellations and Refunds

15.1  You may cancel your order at any time before your test kit has been dispatched and receive a full refund, including any delivery charges paid. Refunds will be processed within 14 days of your cancellation request.

15.2  Once your test kit has been dispatched, you have 14 days from the date of delivery to notify us that you wish to cancel your order. To exercise this right, please email us at admin@smartnutrition.co.uk, quoting your order number, order date, and the name and date of birth of the person the test was for.

15.3  Following cancellation, you must return the kit to us unopened, unused and with all original paperwork within 14 days of notifying us. Please retain proof of postage as we cannot be held responsible for items lost in transit. The cost of returning the kit is your responsibility unless the goods are faulty or incorrect.

15.4  If the kit is returned opened or in a condition suggesting use, we reserve the right to deduct an amount from your refund to reflect the diminished value of the goods. Any such deduction will be proportionate to the loss in value incurred and will be communicated to you in writing before your refund is processed.

15.5  Your refund, including the standard outbound delivery charge, will be processed within 14 days of us receiving your returned kit. We reserve the right to withhold the refund until the kit has been received or until you have provided proof of postage. Please note that premium or upgraded delivery charges are non-refundable.

15.6  Providing complete information when notifying us of your return will help ensure your refund is processed promptly. Incomplete submissions may cause a delay, however refunds will always be issued within the 14-day statutory period.

15.7  Your right to cancel is lost once you have submitted your breath samples to the laboratory for analysis, as the testing service will have commenced at that point. No refund will be due in these circumstances.

15.8  Nothing in these terms affects your statutory rights. If your kit is faulty, damaged or incorrectly supplied, you are entitled to a full refund or replacement regardless of whether the kit has been opened, and you should contact us at admin@smartnutrition.co.uk as soon as possible.

15.9  Refunds will be made using the same payment method used for the original purchase unless you have expressly agreed otherwise.

15.10  This cancellation right does not apply if:

• You have already submitted your breath samples to the laboratory for analysis
• The laboratory has commenced analysis of your samples
• The kit has been opened or used
• The 14-day cancellation period has expired

16. Amending the Name on a Test / Transfer

16.1  The name and date of birth provided at the time of ordering are used to register your test with our Partner Laboratory and must be accurate. If you need to change the name of the person the test is for, please contact us as soon as possible by emailing admin@smartnutrition.co.uk, including your original order number, order date, and the correct name and date of birth of the person the test is for.

16.2  Name changes can only be accommodated within 7 days of purchase and prior to the kit being dispatched and registered with the laboratory. After this point, patient details cannot be altered under any circumstances. An administration charge of £50 will apply to all name change requests, reflecting the administrative and laboratory processing costs involved. Payment will be requested before any amendment is made.

16.3  Smart Nutrition Ltd accepts no liability for results where incorrect patient details were provided at the time of ordering.

16.4  Once test results have been issued, the patient name and details associated with those results cannot be amended under any circumstances. Results are issued in the name provided at the time of ordering and are specific to that individual. Smart Nutrition Ltd and our Partner Laboratory accept no liability where results have been used, shared or relied upon in connection with an incorrectly named individual.

16.5  Test results are personal to the individual named at the time of ordering and cannot be transferred to another person under any circumstances. Results must not be used, submitted or relied upon as the results of any person other than the named individual. Smart Nutrition Ltd accepts no responsibility for any consequences arising from the misuse, misrepresentation or unauthorised transfer of test results, including but not limited to use in connection with insurance applications, employment screening, or clinical decision-making.

16.6  In the event that patient details have been incorrectly recorded by our Partner Laboratory despite accurate information being provided at the time of ordering, please contact us immediately at admin@smartnutrition.co.uk quoting your order number. We will liaise with the relevant laboratory on your behalf to investigate and, where a laboratory error is confirmed, arrange for the details to be corrected and results reissued at no cost to you. Our liability in respect of laboratory errors is limited to the price paid for the test.

17. Cancellation by Smart Nutrition Ltd

17.1  We may cancel your order if: (a) we have insufficient stock; (b) a product is discontinued or removed from sale; (c) we do not deliver to your country or area; or (d) one or more goods were listed at an incorrect price due to a typographical or pricing error.

17.2  If we cancel your order, we will notify you by email and will re-credit any sum deducted within 30 days of your order. We will not be obliged to offer additional compensation for disappointment suffered.

18. Third Party Laboratory Services

18.1  SIBO breath tests offered through this website are processed by an independent, accredited third-party laboratory using certified Quintron equipment. Analysis and reporting are carried out by the Referral Laboratory, which is responsible for its own sample handling, processing and result delivery procedures.

18.2  Smart Nutrition Ltd works with carefully selected, reputable Referral Laboratories but cannot guarantee their turnaround times, accuracy or performance. Once your samples have been dispatched to or received by the Referral Laboratory, Smart Nutrition Ltd is not responsible for any delay, loss or error during processing or reporting. We will liaise with the laboratory on your behalf to help resolve any issues.

18.3  Smart Nutrition Ltd coordinates the ordering process and provides the overall service. We will always support you by communicating with the laboratory to assist in resolving any concerns.

19. Liability

19.1  Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter that cannot lawfully be excluded.

19.2  To the fullest extent permitted by law, our total liability to you in connection with any order is limited to the amount paid by you for the relevant test or service.

19.3  We are not liable for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising out of any issue notified to us under these Terms.

19.4  We are not responsible for delays, losses or errors arising from third-party services outside our reasonable control, including postal services, couriers, customs delays or laboratory processing. We will provide reasonable assistance by liaising with third parties where appropriate.

19.5  We do not in any way exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession) as amended by the Consumer Rights Act 2015; (d) any breach of the terms implied by sections 9 to 11 of the Consumer Rights Act 2015 (description, satisfactory quality, fitness for purpose and samples); or (e) defective products under the Consumer Protection Act 1987.

20. Notices

20.1  Unless otherwise stated in these Terms, all notices from you to us must be in writing or sent by email to admin@smartnutrition.co.uk. All notices from us to you will be displayed on our website or sent to the email address you provided.

21. Third Party Rights

21.1  Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This does not affect any right or remedy of a third party that exists or is available apart from that Act.

22. Vouchers

22.1  Any vouchers must be used within one year of purchase or payment.

23. Community Standards and Conduct

23.1  All content and postings submitted to this website are the sole responsibility of the person from whom they originated. We do not control all postings and do not guarantee their accuracy, integrity or quality.

23.2  You agree not to use the Smart SIBO Test website to upload, post, email or transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, hateful or otherwise objectionable. A zero tolerance policy applies to abusive, offensive or foul language or tone, whether spoken or written.

23.3  You also agree not to: harm minors in any way; impersonate any person or entity; upload material that infringes any intellectual property rights; transmit unsolicited commercial communications (spam); upload software viruses or malicious code; or interfere with or disrupt the website or connected networks.

23.4  We reserve the right to revoke your registration privileges and/or remove any posting without notice for any reason, and to terminate your use of any community feature at our discretion.

24. Parental or Guardian Permission

24.1  Our website and services are primarily intended for adults aged 18 and over. The SIBO breath test may be completed by children over 50 lbs, but orders for children under 18 must be placed by a parent or guardian who accepts these Terms and Conditions on the child’s behalf.

24.2  We do not knowingly collect personal data from children under the age of 13 without the express consent of a parent or guardian. Children under 13 must not register on our website or submit any personal information without parental consent.

24.3  We strongly recommend that all users between the ages of 13 and 17 obtain their parent’s or guardian’s permission before using our website or purchasing any products or services.

24.4  If we become aware that we have inadvertently collected personal data from a child under the age of 13 without appropriate parental consent, we will delete that data promptly. Parents or guardians who believe their child has provided us with personal data should contact us at admin@smartnutrition.co.uk.

25. Links to Third-Party Websites

25.1  These Terms apply only to the Smart SIBO Test website and not to any other company’s or organisation’s website. We may provide, or third parties may provide, links to external websites or resources. We are not responsible for the availability, content, advertising, products or other materials on or available from such external sites.

25.2  Where we refer you to www.ibsandsiboclinics.co.uk or any other third-party practitioner or service, this referral is made in good faith for your benefit. Any engagement with those services is entirely separate from your contract with Smart Nutrition Ltd and is governed by that organisation’s own terms and conditions.

26. Amendments to These Terms and Conditions

26.1  These Terms and Conditions supersede and replace all previous versions. The current version is always available on our website at www.smartsibotest.com and is dated at the footer.

26.2  We reserve the right to amend these Terms and Conditions at any time. Where changes are material, we will notify existing customers by email to the address held on their account at least 14 days before the changes take effect.

27. Entire Agreement

27.1  These Terms and Conditions, together with our current website prices, delivery details, contact details and Privacy Policy, set out the whole of our agreement relating to the supply of goods and services to you. Nothing said by any sales person on our behalf should be understood as a variation of these Terms or as an authorised representation about the nature or quality of any goods offered for sale, save for fraud or fraudulent misrepresentation.

27.2  We make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information published on our website. All liability for any inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

27.3  Nothing in these Terms is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded, nor to exclude or limit our liability to you for death or personal injury resulting from our negligence.

28. Governing Law

28.1  Each and every transaction carried out is deemed to be completed within the United Kingdom. These Terms shall be governed by and interpreted in accordance with English law. The English courts shall have exclusive jurisdiction in relation to any dispute, controversy, proceedings or claims of whatever nature arising in relation to these Terms.

28.2  If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

28.3  Smart Nutrition Ltd may assign its rights and obligations under these Terms. These Terms will inure to the benefit of our successors, assigns and licensees.
